Appeals Court Upholds Premium Cigar Exemption

The U.S. Court of Appeals for the District of Columbia Circuit has affirmed a previous legal ruling against the U.S. Food and Drug Administration in premium cigar regulation. 

The  Circuit confirms that the FDA’s regulatory actions on premium cigars were arbitrary and capricious. 

“This is another affirmation of FDA’s missteps regarding the regulation of premium cigars and the necessity of this lawsuit,”  Joshua Habursky, executive director of the Premium Cigar Association said in a press release. “There are still procedural items ahead, but the biggest question on the Deeming Rule is a significant victory.”

The PCA was among the litigants challenging the FDA’s actions.
