A newly introduced bill in Louisiana, House Bill 623, would establish a three-tier distribution system for tobacco and vapor products, creating a regulatory structure similar to the one used in the alcohol industry.

As drafted, the legislation would significantly alter how tobacco products move through the market by requiring manufacturers to sell only to Louisiana-licensed wholesalers, rather than directly to retailers.

What HB 623 Would Do

Under HB 623, manufacturers, wholesalers, and retailers would be required to operate within separate, distinct tiers of the market. The bill would prohibit manufacturers from holding wholesale or retail permits in the state and would also bar them from having a direct or indirect financial interest in permitted wholesalers or retailers in Louisiana. Likewise, retailers would be prohibited from purchasing tobacco or vapor products from anyone other than a Louisiana-permitted wholesaler.

The bill would also require in-state wholesale distribution of covered products and would prohibit manufacturers from shipping directly to retailers. According to the bill digest, direct shipment to consumers would still be permitted in certain circumstances if the seller holds the appropriate permit.
